Article 370 been removed a historic decision by Modi 2.0 government. The Indian government has taken a landmark decision by abrogating Article 370 and 35A. An agreement which was provisional and temporary for 70 years has been removed.
Readers, today Modi 2.0 govt has written history by removing Article 370, which stated and gave a special division or position to J&K. However, prior to passing amend it first rendered the provision shun by revoking the 1954 Presidential proclamation through a gazette notification in the morning session.
With the revocation that’s ordered, Article 35A now ceases to exist irrespective of how the situation is going to be in parliament on the decision of removal of Article 370. The reason as this was input through the presidential proclamation of 1954, drawing powers from Article 370.
Today morning on 5th August 2019 the government abrogated that proclamation through the Constitution (Application to Jammu and Kashmir) Order, 2019.
“It shall come into force at once, and shall thereupon supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 as amended from time to time” stated the order.
The 1954 order made a discriminatory distinction between Indian and the permanent residents. Article 35A stated the special rights to Permanent Resident Certificates. Those with PRCs only had the rights to property, employment in State government and participation in local as well as assembly elections.
Article 35A ensured that Permanent Resident Certificates will not be struck down on the grounds that they were inconsistent with those given to Indian citizens:
“Notwithstanding anything contained in this Constitution, no existing law in force in the State of Jammu and Kashmir, and no law hereafter enacted by the Legislature of the State…. shall be void on the ground that it is inconsistent with or takes away or abridges any rights conferred on the other citizens of India by any provision of this Part.”
